Before you use the RealtimeStockquote.com("RTSQ")Service, read this agreement carefully. By executing this agreement, you are agreeing to the following terms and conditions:

1. Information RTSQ agrees to provide to the Subscriber information (the "Information") and services on the terms and conditions set out in this agreement.

2. No Liability The Information has been obtained by RTSQ from various data providers, (collectively, the "Data Providers") through sources believed to be reliable. However, RTSQ cannot guarantee the accuracy or the timely delivery of the Information and the RTSQ Service. There may be delays, omissions, or inaccuracies in the Information and the RTSQ Service. The Subscriber agrees that neither RTSQ, the Data Providers nor any agent, subsidiary, or representative thereof shall have any liability, contingent, or otherwise, for the truthfulness, accuracy, or timeliness of the Information or the RTSQ Service, or for any decision made or taken by the Subscriber in reliance upon the Information or the RTSQ Service.

3. Fees The Subscriber agrees to pay all fees related to the the RTSQ Service as set out in the RTSQ Price Information page including any applicable state, provincial or federal taxes. The fees are subject to change, without notice, at the discretion of RTSQ. The Subscriber agrees that RTSQ or its agent or representative, is authorized to obtain payment directly from the credit card account (the "Credit Card Account") provided by the Subscriber to RTSQ. All charges will be recurred either monthly or yearly until you send us a notice of cancellation.

4. Representations and Warranties The Subscriber makes the following representations and warranties, and understands that RTSQ is relying upon such representations and warranties:

(a) the Credit Card Account information provided by the Subscriber to RTSQ is valid in all material respects;

(b) the Subscriber is lawfully authorized to use the Credit Card Account;

(c) the Subscriber shall use the Information and the RTSQ Service for the Subscriber's own personal use; and

(d) the Subscriber is a non-professional, meets the criteria set by North American Quotations, Inc. and has completed a non-professional declaration to North American Quotations, Inc..

5. Non-Assignability The Subscriber accepts responsibility for the confidentiality and use of any access numbers, passwords and account numbers for the Subscriber's access and use of the Information and the RTSQ Service. The Subscriber agrees that all access numbers, passwords, and account numbers are not transferable. The Subscriber is responsible for any fees incurred under their password until the Subscriber advises RTSQ that the password has been lost or stolen.

6. Indemnity The Subscriber agrees to indemnify and hold RTSQ and the Data Providers harmless from and against any and all claims, losses, liability, costs and expenses (including but not limited to attorney's fees) arising from the Subscriber's violation of this agreement or any third party's rights including but not limited to copyright, proprietary and privacy rights. This indemnification and obligation will survive the termination of this agreement.

7. Copyright, etc. The Subscriber agrees that the Information and the data provided by the RTSQ Service is the property of RTSQ or the Data Providers and is protected by law including copyright and trademark. The Subscriber agrees not to reproduce, retransmit, disseminate, sell, distribute, publish, broadcast, circulate or commercially exploit the Information or the data provided by the RTSQ Service in any manner or for any purposes without the prior express written consent of RTSQ and the relevant Data Providers.

8. Damages The maximum aggregate liability of RTSQ for all the claims arising out of or relating to this agreement, regardless of the form or cause of action, shall be the amount the Subscriber originally paid for the Information and the RTSQ Service, if any. Neither RTSQ not the Data Providers shall be liable for any loss resulting from a cause over which such entity does not have direct control, including but not limited to failure or incompatibility of electronic or mechanical equipment, software, or communication lines, telephone or other interconnect problems, unauthorized access, theft, operator errors, severe weather, earthquakes and strikes and other labor problems.

9. Modification The Subscriber may add or cancel additional services offered by RTSQ electronically or by written notice, subject to confirmation and to payment of all applicable fees.

10. Opt-In Marketing List When you register with us, we include the contact information (name and email) you provide us on our opt-in marketing list. We may "rent" our opt-in marketing list to third parties who have special offers that may be of interest to you. Please note that we "rent" our marketing list, but we do not sell your information to third parties. Additionally, we are selective about which companies we permit to send you an offer. Our goal is for the e-mails to be of value to you. As always, you can unsubscribe from these e-mails at any time by sending email to support@realtimestockquote.com with subject "Opt-out of marketing list"

11. Termination by RTSQ reserves the right to terminate this agreement, in full or in part, at any time, without notice.

12. Termination by the Subscriber The Subscriber may terminate this agreement at any time, however, termination will not be effective until the end of the current month following receipt by RTSQ of notice of the termination. Notice must be provided to RTSQ in writing by facsimile or electronic mail.

I hereby subscribe to the RTSQ Service provided by RTSQ and agree to pay the charges incurred through the payment method as indicated above.
